Terms of Service

These Terms govern access to bashrack websites, infrastructure, APIs, support, and related services (the "Services"). "bashrack", "we" and "us" mean the operator of the Services; "you" means the account holder. You accept these Terms by ticking the acceptance box when you register or when the console asks you to, and you may not order Services or add funds before accepting the current version. We record the version you accepted and when.

The agreement consists of these Terms, the Acceptable Use Policy, the Data Processing Agreement (for personal data in your workloads), and the details of each order. Our Privacy Policy explains how we handle personal data about you. If you act for an organization, you confirm that you may bind it. Mandatory rights under applicable law are not excluded.

bashrack provides virtual servers, dedicated servers, managed application and database hosting, storage, networking, and related tools. Features, regions, capacity, prices for new orders, and integrations may change. Unless a separate written service-level agreement applies, the Services are provided on an as-available basis without a specific uptime or response-time guarantee, and no service credits are owed.

Every order can take up to 48 hours to provision. We'll email you as soon as your service is ready.

Features labelled beta, preview, or free trial, including VPS backups while they are offered free of charge, are provided as is, may be incomplete, may change or be withdrawn at any time, and carry no commitment that data can be recovered from them.

You must be at least 18 and legally capable of entering a contract. You must provide accurate account and billing information and keep it current. New accounts are reviewed before they can order. We may at any time ask you to verify your identity, address, organization, or payment method, and may decline, limit, or close an account without stating a reason, including when information is false, incomplete, or cannot be verified. Each account is for one person or organization; creating accounts to evade limits, suspensions, or verification is prohibited.

You confirm that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions, are not listed on or owned or controlled by a person listed on a sanctions list of the United Nations, the European Union, the United Kingdom, or the United States, and will not use the Services for anyone who is. We may refuse or end Services where providing them could breach sanctions or export-control laws.

You must comply with the Acceptable Use Policy, which forms part of these Terms, and respond promptly to abuse reports about your resources. We may investigate suspected abuse and take proportionate action, including filtering, null-routing, isolation, or suspension. A complaint or blacklist entry may trigger investigation but is not by itself conclusive proof.

You have full administrative control of your servers and workloads and are solely responsible for their software, configuration, patching, access, security, content, and lawful use, including activity by anyone you give access to. A compromised resource remains your responsibility; we may isolate it until it is secured.

You are responsible for credentials, API tokens, webhooks, and every action taken with them, including orders and changes made by scripts, integrations, or AI agents you connect (for example through MCP). Keep tokens secret, enable two-factor authentication, and notify support promptly of suspected unauthorized access.

An organization owner is responsible for the members they invite and for usage they create on shared resources, which is charged to the owner's wallet. Account resale is prohibited unless approved in writing.

Prices are shown before purchase and denominated in USD. Usage fees begin when a resource is deployed or reserved and continue until deletion or as stated in the order flow. Stopping a resource pauses only charges expressly identified as pausable. For a stopped VPS, compute (CPU and RAM) is paused while its disk and public IPv4 address, and any backups and additional addresses, continue to be charged until deleted. Taxes and payment-provider conversion or network fees may apply.

Wallet balance is prepaid credit usable only for bashrack Services. It is not a bank deposit, electronic money, or a stored-value instrument, earns no interest, cannot be transferred to another account, and has no cash value except as stated under Refunds. Payments in a cryptocurrency or another currency are credited at their USD value when the payment is confirmed. If your balance falls below the allowed limit, resources it pays for are suspended and resume after a top-up. You must pay any negative balance.

Prospective price changes for existing resources receive at least 7 days notice; earlier usage keeps its earlier rate. We may correct obvious pricing or billing errors.

Dedicated servers are billed monthly in advance from your wallet and renew each month until cancelled. If a renewal cannot be charged, a 7-day grace period starts; a server still unpaid afterwards is suspended and may then be cancelled and wiped.

An order cancelled before the server is handed over is refunded to your wallet. After handover, the month already paid is not refunded when you cancel. Dedicated servers run in third-party data centers, may use previously used hardware, and their specifications, locations, and remote actions depend on that hardware and facility. Hardware faults are handled with reasonable effort; a replacement may be a comparable server rather than the same model. Data-center rules that apply to the server, such as restrictions on outgoing email or cryptocurrency mining, are part of the Acceptable Use Policy.

Unused prepaid balance may be requested for refund within 7 days after funding, except promotional or test credit, consumed amounts, non-refundable provider or network fees, or where fraud, abuse, chargeback, sanctions, or law requires another result. Refunds go to the original payment method where possible; cryptocurrency payments are refunded at the USD value credited, less network fees, to an address you control. Approved refunds are processed within up to 14 calendar days after a complete request; provider settlement may take longer.

If you are a consumer with a statutory right of withdrawal, you may withdraw within the period the law gives you. When accepting these Terms you expressly request that the Services you order start immediately; if you withdraw, you pay for the Services provided until withdrawal, and the right ends once a Service has been fully performed. Any other mandatory consumer rights remain unaffected.

You authorize each transaction you initiate. Contact support before filing a chargeback or payment dispute. While a dispute is open we may suspend the affected account and payment features. If a payment is reversed, we may deduct the amount from your wallet, suspend or terminate resources it paid for, and recover the reversed amount, dispute fees, and reasonable collection costs as permitted by law.

We may suspend or terminate an account or resource for breach of these Terms or the Acceptable Use Policy, non-payment, failed verification, reasonably suspected fraud or abuse, security risk, legal requirement, or to prevent material harm. Where circumstances permit, we give notice and an opportunity to cure. Immediate action may be taken for urgent security, abuse, fraud, or legal reasons. When we restrict a resource because of its content or use, we tell you the reason unless the law or an investigation prevents it, and you can reply through support.

Resources suspended for non-payment may be terminated after 30 days of suspension; we email the account owner before a managed app or database is terminated. Suspension does not necessarily stop storage, address, or other continuing charges. You may cancel resources at any time from the console or through support. Data of a terminated resource may be permanently deleted, so export it and keep independent backups before cancellation.

You retain rights in content you process. You grant bashrack a limited worldwide license to host, copy, transmit, back up, and process it only to provide, secure, support, and comply with law regarding the Services. You represent that you have the necessary rights and lawful basis. You are solely responsible for keeping independent, tested backups of your data. Platform backups and snapshots are operational aids, not a guarantee of recovery, unless a purchased service expressly says otherwise.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". BASHRACK DISCLAIMS ALL IMPLIED WARRANTIES AND CONDITIONS, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DATA WILL NOT BE LOST, OR THAT IP ADDRESSES WILL HAVE ANY PARTICULAR REPUTATION OR EMAIL DELIVERABILITY. Nothing excludes warranties that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASHRACK IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA. AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE FEES YOU PAID FOR THE AFFECTED SERVICES DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply where liability cannot lawfully be limited, including fraud, wilful misconduct, or death or personal injury caused by negligence where applicable. Nothing limits mandatory consumer rights.

To the extent permitted by law, business users will defend and indemnify bashrack from third-party claims, fines, and reasonable costs, including legal fees and costs of handling abuse, arising from their content, workloads, unlawful use, breach of the Acceptable Use Policy, or material breach of these Terms. This does not cover claims caused by bashrack's breach, negligence, or wilful misconduct. We will give reasonable notice and allow control of the defence, subject to our participation and approval of settlements imposing obligations on us.

The Services are not designed for uses where failure could lead to death, personal injury, or severe physical or environmental damage, such as life-support, medical-device, aviation, nuclear, or emergency-response systems. You may not use them for such purposes without a separate written agreement.

The Services rely on third-party networks, data centers, software, payment and identity providers, and infrastructure. Their availability and separate terms may affect the Services. bashrack is not responsible for third-party systems outside its reasonable control, but this does not limit obligations applicable law places on bashrack.

Applicable law governs these Terms. Before filing a claim, each party should give the other a reasonable opportunity to resolve it through support. Nothing deprives a consumer of mandatory protections or access to an available court or dispute body.

Neither party is liable for delay caused by events beyond reasonable control. You may not assign these Terms without written consent; we may assign them with a transfer or reorganization of the Services. These Terms are the entire agreement about their subject and replace earlier terms for future use. The English version prevails over any translation. We may send notices electronically to your account email or in the console. Unenforceable provisions are limited to the minimum necessary; the remainder stays effective. Failure to enforce is not a waiver. Provisions that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and indemnities, survive it.

We may update these Terms for legal, security, operational, or product reasons. Material changes carry a new date and must be accepted in the console before you place further orders or add funds; existing resources keep running meanwhile. Changes do not retroactively alter incurred fees.
