Terms of Service

1. Acceptance

These Terms govern access to bashrack websites, infrastructure, APIs, support, and related services (the "Services"). By creating an account, placing an order, or using the Services, you agree to these Terms and our Privacy Policy. If you act for an organization, you confirm that you may bind it. Mandatory rights under applicable law are not excluded.

2. Services

bashrack provides virtual servers, managed application and database hosting, storage, networking, and related tools. Features, regions, capacity, and integrations may change. Unless a separate written service-level agreement applies, the Services are provided on an as-available basis without a specific uptime or response-time guarantee.

Every order can take up to 48 hours to provision. We'll email you as soon as your service is ready.

3. Accounts and Security

You must be at least 18 and legally capable of entering a contract. You must provide accurate account and billing information and keep it current. You are responsible for credentials, API keys, authorized users, and account activity except to the extent caused by bashrack. Notify support promptly of suspected unauthorized access. Account resale is prohibited unless approved in writing; supported organization access is permitted.

4. Acceptable Use

You may not use the Services for unsolicited bulk email; malware; denial-of-service; unauthorized access, scanning, phishing, credential theft, or fraud; unlawful or infringing content; cryptocurrency mining without written approval; open proxies or TOR exit nodes; sanctions or export-control evasion; or interference with any system. You must respond promptly to substantiated abuse reports concerning your resources.

We may investigate suspected abuse and take proportionate action, including filtering, isolation, or suspension. Urgent action may occur without notice where reasonably necessary to prevent harm, comply with law, or protect the Services. A complaint or blacklist entry may trigger investigation but is not by itself conclusive proof.

5. Billing, Wallet, and Refunds

Prices are shown before purchase and generally denominated in USD. Usage fees begin when a resource is deployed or reserved and continue until deletion or as stated in the order flow. Stopping a resource pauses only charges expressly identified as pausable. Storage, reserved addresses, licenses, bandwidth, overages, and third-party costs may continue. Taxes and payment-provider conversion or network fees may apply.

Unused prepaid balance may be requested for refund within 7 days after funding, except promotional or test credit, consumed amounts, non-refundable provider or network fees, or where fraud, abuse, chargeback, or law requires another result. Mandatory consumer cancellation and refund rights remain unaffected. Approved refunds are processed within up to 14 calendar days after a complete request; provider settlement may take longer.

You authorize each transaction you initiate. Contact support before a chargeback where practicable. We may restrict payment features during a dispute and recover properly incurred fees, negative balances, or reversed credits as permitted by law. Prospective price changes receive at least 7 days notice; earlier usage keeps its earlier rate.

6. Suspension and Termination

We may suspend or terminate an account or resource for material breach, non-payment, reasonably suspected fraud or abuse, security risk, legal requirement, or to prevent material harm. Where circumstances permit, we will give notice and an opportunity to cure. Immediate action may be taken for urgent security, abuse, fraud, or legal reasons.

Suspension does not necessarily stop reserved-capacity, storage, address, license, or other continuing charges. Data associated with a terminated or deleted resource may be permanently deleted. Export data and maintain independent backups before cancellation.

7. Customer Content and Backups

You retain rights in content you process. You grant bashrack a limited worldwide license to host, copy, transmit, back up, and process it only to provide, secure, support, and comply with law regarding the Services. You represent that you have the necessary rights and lawful basis. Snapshots and platform backups are operational aids, not substitutes for recoverable independent backups, unless a purchased service expressly says otherwise.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASHRACK IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA. AGGREGATE LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF USD 100 OR FEES PAID FOR THE AFFECTED SERVICES DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply where liability cannot lawfully be limited, including fraud, wilful misconduct, or death or personal injury caused by negligence where applicable. Nothing limits mandatory consumer rights.

9. Indemnification

To the extent permitted by law, business users will defend and indemnify bashrack from third-party claims and reasonable costs arising from their content, unlawful use, or material breach. This does not cover claims caused by bashrack's breach, negligence, or wilful misconduct. We will give reasonable notice and allow control of the defence, subject to our participation and approval of settlements imposing obligations on us.

10. Third-Party Services

The Services may rely on third-party networks, software, payment and identity providers, or infrastructure. Their availability and separate terms may affect the Services. bashrack is not responsible for third-party systems outside its reasonable control, but this does not limit obligations applicable law places on bashrack.

11. Disputes and General Terms

Applicable law governs these Terms. Before filing a claim, each party should give the other a reasonable opportunity to resolve it through support. Nothing deprives a consumer of mandatory protections or access to an available court or dispute body.

Neither party is liable for delay caused by events beyond reasonable control. You may not assign these Terms without written consent; we may assign them with a transfer or reorganization of the Services. Unenforceable provisions are limited to the minimum necessary; the remainder stays effective. Failure to enforce is not a waiver.

12. Changes and Contact

We may update these Terms for legal, security, operational, or product reasons. Material changes will carry a new effective date and, where reasonably practicable, advance notice through the Service or email. Changes do not retroactively alter incurred fees.

Submit questions, billing matters, and legal notices through our contact page. Abuse reports should identify the resource, timestamps, evidence, and contact details sufficient for investigation.
