Terms of Service

1. Acceptance

By accessing or using bashrack services, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, you may not use our services. We reserve the right to refuse service to anyone for any reason at any time.

2. Service Description

bashrack provides dedicated VPS rental on an as-is and as-available basis. We do not guarantee uninterrupted, timely, secure, or error-free service. Downtime, hardware failures, and network interruptions may occur without notice.

3. Account & Eligibility

You must be at least 18 years old. You are solely responsible for maintaining account security, including passwords and API keys. Any activity under your account is your responsibility. We may suspend or terminate accounts without prior notice if we suspect unauthorized use, fraud, or violation of these terms.

4. Acceptable Use

You may not use bashrack services for: sending unsolicited bulk email (spam), distributing malware, conducting DDoS attacks, hosting illegal content, mining cryptocurrency without explicit written approval, running TOR exit nodes, or any activity that violates applicable law. We have sole discretion to determine what constitutes a violation.

If your IP range is listed on any public abuse blacklist, we may suspend services immediately without refund.

5. Billing & Payments

All fees are billed hourly from deployment time and drawn from your prepaid balance. Unused prepaid balance is refundable within 7 days unless otherwise required by law. You are responsible for all charges incurred on your account, including overages, bandwidth excess, and IP address fees.

Refund requests are reviewed manually and require a minimum processing time of 48 to 72 hours from the time the request is submitted. This waiting period allows us to verify account activity, confirm the request, and prevent fraudulent claims. Refunds are not processed instantly and submitting multiple requests will not expedite processing.

We may change pricing at any time with 7 days notice. If you do not agree to new pricing, your sole remedy is to cancel before the change takes effect.

6. Termination & Suspension

We may suspend or terminate your access immediately and without notice for: violation of these terms, non-payment, suspected fraud, abuse complaints, legal requests, or any reason we deem necessary to protect our network or business. Upon termination, all data may be permanently deleted without obligation to retain backups.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASHRACK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO BASHRACK IN THE 30 DAYS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless bashrack from any claim, demand, loss, liability, or expense arising from your use of the service, your content, or your violation of these terms.

9. Data & Backups

You are solely responsible for maintaining backups of your data. bashrack is not liable for data loss under any circumstances, including hardware failure, termination, or accidental deletion.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which bashrack operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in our jurisdiction.

11. Changes

We may modify these terms at any time. Continued use constitutes acceptance of the updated terms. Material changes will be posted with an updated effective date.
